1. Acceptance of Terms
By accessing or using the Agentic AI Marketing Platform (“Service”) provided by Promarkia Inc., you agree to these Terms of Service. If you do not agree, please do not use the Service.
2. Definitions
- “Service” means the Agentic AI Marketing platform, including all software, APIs, and documentation.
- “User” means any individual or entity accessing or using the Service.
- “Content” means any data, text, images, or other information you submit through the Service.
3. Scope of Service
Promarkia provides AI-driven marketing automation features, including:
- AI-powered content generation
- Automated social media posting
- Analytics dashboards
- Integrations with Google Workspace, Microsoft Teams, HubSpot, Salesforce, Notion, Slack, Discord, LinkedIn, Reddit, and X
4. Security Measures
We employ robust security protocols to protect your data:
- Infrastructure Security: AWS hosting, Ubuntu Firewall & Pro/ESM, Cloudflare WAF, AWS GuardDuty.
- Application Security: React.js front end, Firebase Authentication, secure OpenAI integration.
- Data Encryption: SSL/TLS for data in transit; end-to-end encryption for sensitive data.
- Access Control: SSH with certificate-based authentication, IP whitelisting, and two-factor authentication (2FA).
- Threat Detection: CloudMersive malware scanning of all uploaded files.
5. User Responsibilities
- Account Security: Keep your credentials confidential and secure.
- Acceptable Use: Do not misuse or disrupt the Service or attempt to breach its security.
- Compliance: Abide by all applicable laws and third-party terms when using the Service.
6. Data Privacy
Your use of the Service is governed by our Privacy Policy, which explains how we collect, use, and share your personal data.
7. Intellectual Property
All rights, title, and interest in the Service and its components remain with Promarkia or its licensors. You receive only a limited, revocable license to use the Service as permitted by these Terms.
8. Disclaimers & Limitation of Liability
- No Warranty: The Service is provided “as is” without warranties of any kind.
- Limitation of Liability: Our liability is limited to the fees you paid in the three months before any claim.
9. Termination
We may suspend or terminate your access to the Service if you violate these Terms or for any other reason, in our discretion. Upon termination, your right to use the Service immediately ends.
10. Changes to Terms
We may update these Terms periodically. We will post any changes here with a new “Effective Date.” Continued use after changes constitutes acceptance.
11. Governing Law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada, without regard to conflict-of-law principles.
